P45 and tax code problem

I finished a temporary job on 30th Nov, working Tue/Wed/Thur a total of 22.5 hrs per week. I accrued around 39.5 hours holiday pay which was paid after I finished. I received a P45 from this job with the "leaving date" completed with 16th Dec. Can this be correct? Does it matter whether "leaving date" is 16th Dec or 30th Nov or some other date?
I was also on a week 1 tax code since the start of the above job (started in Aug) and this is now shown on my P45 which means that if I provide this P45 to my new employer I will again be taxed on a week 1 rate in my new job which I started on 1st Dec.
Should I just complete a P46 instead of using the P45 I was issued with and then contact my tax office directly to try and get a rebate for the overpayment of tax (traveling so not working for around 2months this summer).. or should I approach this in a different way? Has anyone else been in this kind of situation? Any help or advice would be great.

It makes no difference. Its the amount on the income and tax paid that counts.
You would probably get taxed Week 1 regardless until your new employer got the tax coding notice from HMRC which takes a few weeks. With that notice they would also be told if there is any tax to be refunded.0 -

If you provide a P46 instead of a P45 you will have to tick Box B to say that you have already had a job since April 6th. With Box B ticked the employer must use the emergency code on a non-cumulative basis so 747L Mth1.
Handing your P45 over is the best way.
Then give it a few weeks and contact HMRC to see if you can get off that Mt1 code. As soon as the cumulative tax code is used you will get an automatic refund.0 -

This may have saved you some NI by spreading the payment out instead of in one lump amount. It looks to me as though you had been paid as though the holiday time was taken (between 1 and 16 December) and not simply paid as an accrued amount.0
