Been Stupid....

Like so many people on this forum, I managed to live beyond my means with Payday Loans/Credit Cards for too long, I'm now with CCCS since the summer who'd been brillant & the annoying phone calls/texts have stopped, & the mess is starting to be sorted out. Apart from one Creditor, who have been very hostile,rude & what I consider to be undue Pressure put on myself. I have explained to them I'm with CCCS, They're company policy is not to deal with 3rd party companies "You signed the Document, its your problem" they have said, which I understand their point, I have offered the amount CCCS have calculated I can afford to pay, "Thats not an acceptable amount", They have said. So this vicious circle of saying the same things each time, continues. CCCS have confirmed each payment has been banked & they deal with this company regularly. A Default Notice has been issued, I haven't got this money, What can they do?What are my rights?

    they can take you to court for a CCJ, the judge will review what you can afford and order you to pay that. Which will look very like your current offer to them I expect.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    You might want to write to this creditor and point out that it is against OFT debt collection guidelines to have a company policy not to deal with 3rd parties - see this link - UPDATED OFT Guidance on Debt Collection - READ IF YOU ARE BEING HASSLED UNFAIRLY section 3.9c. You could also read through the rest of that document to see which other of the guidelines they are not adhereing to.

    In terms of hassle to yourself if they are ringing you there is a template letter to insist all future communication is in writing.

  • Also, remember you cannot get blood out of a stone so just ignore all their bluster (I know this is easier said than done).
