liability order and moving out, help required

Hi everyone,

Me and my girlfriend have been living in a flat together since July, we paid the first months council tax but then we had problems for the next few months, we were sent to court which we could not attend but they issued a liabilty order and said that we had to pay the whole years worth of council tax, we need to pay an installment this month of £250 and then 2 further payments over the next 2 months.

We have now decided that we need to move as we can not afford the rent, council tax etc etc. We are moving back to my parents next week.

Does anybody know if we have to pay the full 12 months worth of council tax still or will the amount we need to pay only be the amount for how long we have missed the payments so far?

    You should never have been assessed as owing 12 months if you did not move in until July.
    You will be reassessed when you move out and will be due council tax from the move in to move out dates.
    You should be able to work out a daily rate from your council tax bill and see how much you will still be due, it will probably be slightly less than the missed payments as most take 10 months payments per annum and not 12
  • Brilliant, thank you Caz, il get on to them in the week and tell them we are moving, that has made me a lot happier that we wont have to pay it all, Christmas would have to have been stretched even more.

    There is a slight problem with you just "moving out".

    If your landlord agrees to you surrendering your tenancy then the Council Tax liability is his from the date of surrender. However if you just move out, then if the tenancy has not ended, you are still considered to be the person(s) with the right to occupy and the CT liability remains yours until the tenancy ends or there is a new occupier, whichever is the sooner.
