Re: EARLY BR DISCHARGE ENQUIRY.....

Hi guys,
Has anyone applied for an early BR discharge and been granted please (ie. like after 6 months or so)?

Just checking out all options... :)

    I was told by the OR's clerk that my file was concluded and I could ask to be considered for ED after 5 months. I did this and the OR kindly agreed to process the ED, it went through about 2 months later.

    You can ask, but it's never guaranteed, even if your OR agrees to process it. ED is the lowest priority and OR offices are understaffed and very busy these days so it still may not happen if they haven't the time to pick up your file at all stages of the ED process.

    If all the investigations into your BR haven't been concluded then you probably won't be considered for ED, worth ringing up and speaking to the clerk in the office to find out where things are at and whether they might consider a request for ED. I guess some offices won't due to how busy they are anyway.

    When i phoned them on 16th December to check up on the progress of my case and other questions,the lady that i did speak to told me that my file was the easiest one to handle (whatever that means )..lol...:huh:
    Im using this opportunity to try all options ...Not that im dashing off to get credit (wouldnt even dream of it!)..Just to start strengthening my credit file...

  • ED is very rare in Scotland, in fact, I haven't heard of anyone going LILA BR getting ED. You can always ask but I think you'll probably have to go the full 12 months. we can't complain cause we only pay £100 to go BR!

    Ah, forgot you were in Scotland and that ED is highly unlikely for LILA.

    I wouldn't worry too much about rebuilding your credit in a few months or a year as the BR will stay on your files for 6 years anyway. Cleaning up credit files and building a good credit history is a lot about being in a better position at the 6 year mark.

    I'm not aware of any process for early discharge in Scotland. Maybe if you come into a windfall, and can pay off all of your debts and the trustee's fees.... :D

    Even then, I think you have to sign an undertaking that you'll cough up for any other debts that happen to appear.

    At least you're just bankrupt for a year now - that only changed three or four years ago. Before that, it was a full three years before you got discharged :eek:

    @Ineedaname I was just looking through forum posts for experiences about early discharge and found this thread. I had some special circumstances (illness) that I asked the OR to consider and they kindly said they will process early discharge as my case was straightforward anyway. Now I'm just wondering how long this will take. You said yours was about 2 months - can you tell me, did you have to do anything else or was it just waiting for 2 months (provide any more info etc) and then you received a letter? They said that they will have to write to the creditors and if they do not object then it can be processed. Anyway just curious for anyone elses experience of asking for early discharge and the process of receiving it.

    From memory, I sent a letter to the OR herself (was given her name by the clerk) and she then sent me an SOA to complete and return. Upon receipt of that I received a letter confirming I would be considered. At that point it's the same as you were told, they write to the creditors and as long as nobody object they then apply to the Court for the ED.

    The process is expected to take about 2 months to give creditors time to respond and for the time it takes to apply to the Court. I actually rang up just after 2 months and was told my ED had been processed the week before, so had been ED for a week and not known! The clerk just needed to send the confirmation letter out to me.
