Delivered something I didn't order

Options
Hi all,

I recently received a second pair of trainers that I hadn't ordered. I've informed the company and told them that they can send a courier on a number of dates or compensate me for the inconvenience and time I need to take out of work to go and post the goods to them. The company won't compensate me apart form postage and package costs and are unwilling to pay for a courier. My question is this: is there a specific law that states that when a company makes a mistake and sends you goods then they must arrange to have the goods delivered back to them via courier or the like? If so where can I find this. Many thanks for your time

I'm sure someone more knowledgeable will give better information, but I'm sure that your obligation extends to making 'reasonable' effort to have them collected. I would consider telling them that on x day of x month, you will at home for a courier to collect them - especially if they normally use a courier to deliver & collect - then that would be fairly reasonable. If they are unwilling / fail to collect, then that's their issue.

Goods sent in error remain the property of the sender but as such, you have a responsibility to take reasonable care of the products and make them available for collection - at their expense and at your convenience.

look up unsolicited goods act, which has been reinforced by the distant selling regulations 2000.someone else here will be more knowledgeable than me.

in the past if this happened to me,i would write and say according to the unsolicited goods act blah blah blah...i would give them X amount of time to pick them up...otherwise they became my property..free....always worked....or in one case i ended up with 3 extra bookcases and 1 extra triple wardrobe..double my original order. they obviously thought the cost of picking them up was not worth the cost of the furniture.

Thanks for your replies, reading the unsolicited goods act though I'm not sure it is relevant. I can see that the goods were sent in error but just want the company to arrange a courier for convenient times to come and collect them. Is there any section of an act which I can send to the company?
  • Can you not get them collected from your place of work?

Why is it such an inconevenience to just wrap them up and take them into the post office next time you pass one.

You havent lost anything, In fact if you just find some old wrapping paper and use a bit of sellotape, you can pocket the
    packaging cost.

What kind of compensation were you looking for

Not everyone can get to a post office during their opening hours, and even if this is possible there may well be parking charges to pay for. (the nearest PO to me is in a big town and the minimum parking fee is now £1.20).

The company concerned screwed up so they should be responsible for arranging for a courier to collect their goods.

I can get them collected at my place of work but the company is unwilling to send a courier. I'd be happy to take the goods to a post office but I don't have enough time in my lunch to get there. I'd need to take a longer lunch and work longer hence required compensation for my time.

I'd email them, and tell them that they've delivered the goods by error, and could they either arrange a courier to pick them up on one of the following dates (give them a selection of dates), or send you the sum of £x which will cover special delivery postage, packaging, and 1 hour of your time at minimum wage to go and post them.

McKneff, either you have a fantastic local post office, or haven't been in one before! The only ones I've been in have long queues, and often lousy parking, so it's highly inconvenient!

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
