Confused ... needing help

This is a bit of a difficult one, hoping someone might be able to help me.

Long story short

My boss has a very angry nature and became verbally abusive to me on several occassions past month or so (i've been called a c*nt and been told im useless), he got wind of me not being happy there and thinking about leaving... this is when the trouble started

I became self employed for this job (as an administrator which tbf i shouldn't of been self employed)

Anyway past week has just been awful, i've left work in tears each time

I was the model employee, came in early, left late... never taking a lunch break... until today, where im obviously the WORST EVER...

I found on my pc a keylogging / screenshotting system, turns out my boss was logging every single thing i did on a day to day basis for possibly a week (maybe less)

I found screen shots to my banking my personal emails etc as well as my actual login for these in a text file

I questioned him and that was when he told me he didn't like me using the internet on company time, i explained to him i was hardly on it and it was usually to check my bank balance or reply to a family member via email.

He then accused me of using my mobile constantly (calls/texts), impossible because its a dead zone there and i can provide my phone bill to prove this point (but this is besides the point).

I pointed out that he had never told me in all time of me being there that i was unable to use the company pc to check my personal email/bank account nor that I was not able to use my mobile phone (funniest thing is his other staff use to text me to tell me to get him to contact them - so it was used for work anyway). I was never given any company policy details etc

The company is a small company (family run) and basically avoids paying its bills at the best of times (i've never been paid on time). But now i've been told my outstanding 2 weeks money will not be paid because i visited 2 websites and my phone rang once and i put it on silent and rejected the call, obviously that means im doing nothing but gabbing on it =\ his words "I'm not paying you to do personal things", I was just in pure shock, he left the conversation as "It's Christmas, go home, we finish today until 3rd Jan anyway and I'll call you and we'll discuss if this job is what you actually want to do"

Basically he's making it sound like in my court, he knows i don't want to go back after the abuse i've taken of being a human punchbag as well as the fact i found out he was logging my every move for a few days. I just want my outstanding 2 weeks money this is all... I honestly don't know what to do, he's messed me over for Christmas and he knows this

I wish I knew more about this to use this threat, him and his wife don't get a wage either, they get the money she's invested in the companies back + a % of interest (something like 5k back every month) but they don't pay tax

I honestly dont think they've paid my 20% tax for the CIS scheme either for 4 months since i've never received anything from them but they debduct it from me.

Do you know if he's still using the key logger?

If he is you want to email a solicitor from work asking them for legal advice explaining everything they're doing.

Although if he's never set out an IT policy that he'll be monitoring your emails and calls then he's done himself no favours by being caught out.. http://plc.practicallaw.com/1-369-8081

It doesn't matter now we closed for Christmas today (because they want to spend time with their kids) anyway just love how they refuse to pay me cause they don't need me in monday lol

This is construction industry - right? In which case Emmzi's usually impeccably correct advice is wrong. CIS schemes are legitimate HMRC registered an self-employment. I use "legitimate" in the loosest sense of the word. But they are legit,. Only one piece of advice will do. Get out, get out as quickly as you can. Sorry

Yeah I appreciate that advice, i really won't be going back, but still would like what i'm owed, since i was told im not getting a penny of 2 weeks wages (9-5 mon to fri), not sure how to go about it though?

The normal self-employed way - issue an invoice. If they don;t pay then you issue a leter before action and then take them to small claims court if they still don't pay up. I'', afraid there isn;t an easier way. Most pay up before court though.

They've already got CCJ's due to ignoring court summonds, infact theyre going to court on monday to try get a CCJ removed apparently
