A couple of issues

Hi all,

I started a new job about 3 weeks ago and it's really not to my taste. It's completely dire and unchallenging and is affecting my personal life. I've had a look around and have secured myself a new job with more hours and better pay. Anyway, in my contract it didn't state a period of notice I had to give. I don't have a copy but as I've only been there for 3 weeks isn't it just a weeks notice?

Another thing, it's been very heavy snow where I live so I physically cannot get into work. I rang my boss and it was if she didn't believe me, she keeps asking for me to come in but I physically can't (will also say that buses aren't running). Is there any way she can penalise me for this?

I can't wait to leave this job and start my new one. :T

    ok, not all of them but the work related ones.
  • Yes, without a contract stating anything different, one week is the statutory amount of notice you need to give.

    Your employer doesn't have to pay you for days you don't work - even if it's because you are stuck in snow. So you might well have those days deducted from your pay; firms can set their own policy on this. Some pay, some don't. But if you hand in your notice I'd be expecting not to be paid these days...

    Not exactly.....

    There is a common law requirement to give "reasonable notice".

    As we know lawyers earn huge salaries debating what is reasonable but I can't imagine it would be an issue (apart from getting a reference maybe).
  • Notice you must give your employer
    If you have worked for your employer for one month or more, the legal minimum amount of notice you must give is one week.
    Normally your employment contract will set out a longer notice period. If it does, you should give this length of notice to your employer.

    The above is from the direct gov website so I would have thought under the month statutory as its not defined is nothing.

    Only if employed for more than one month is the statutory notice period one week.

    Not really, but I've had a couple of interviews in the past week and got the job with one of them. However, I have been applying to every job under the sun, as the current one is cr*p (to put it bluntly).

    Just think, if you battled your way into work today, you could have been out before next weekend, rather than after.
