Letters TO dca's

good morning all

I am looking for the sample letters to send to dca's about :-
1--we only want to talk via letter, not on the phone
2---the debt is in dispute and so should not have been sold on to the dca in the first place.

Also, the person who owes the money is on benefits, has just been refused esa because they did not get the form ( despite it being handed in to the job centre in person) so has no income at all at the moment. Is there a sample letter to explain this sort of situation?

Many thanks to anyone who can help. I had thought there was a sticky but could not find it. I am not as young as I was, so quite possibly could have missed it.

    2) There is no absolute prohibition against a disputed debts being sold on, but if the sale and conduct of the buyer and seller when doing it unfairly makes it more difficult for the debtor, then they may be in breach of one or more rules here: https://forums.moneysavingexpert.com/discussion/3558031

    You may be able to adapt one of the ones on the National Debtline site to suit.

    May be better to just write explaining in your own words though.

    The OFT guidelines in link 2 in the previous post have sections stating that a DCA/creditor should not be demanding payment on a disputed debt, and that they should not be asking someone who cannot afford to pay more to do so.

    So you could add some quotes/references in from that?

    She is very worried about the debt, taken on when she was working. She has just been diagnosed with a rare form of immune disorder and it does not fit with the ATOS mind set, so has been battling to get some money for several months. she has moved to stay with family because she is unable to stay on her own, but the bank have not been sympathetic. She quite literally has nothing, no property, few belongings and no money. The bank cannot have what she has not got, but although they know this they will not leave her alone.

    I feel so bad for her at the moment. Her life has collapsed around her ears and she has robinson way phoning several times a day as well.

  • Hi I'm not sure if this is the wrong place or not but last night I got a letter from Robinson way ask for a Mrs K McCraith, now I'm a Mr K McCraith and the Mrs is my mum, the letter said Mrs McCraith you previously lived at the above address and we believe you may now reside here standard sort of letter, but the address stated in the letter is my home address back home so why would they be looking for my mum at my address in England when my mum lives in Ireland? It doesn't hav a reference number or any debt details on the letter, the reason I'm worried is my girlfriend and I are applying for a mortgage and I'm worried I could end up payin for my mums problems, I asked her and she said she's heard of them but has no record of who they're actin on behalf or anything? As much advice needed as possible please!!!
