Missed Court Date for Insolvency Hearing ??

  • Hi, yes got a letter from the Court stating that I had been made bankrupt. I then received a letter from the OR with an appointment to go in and see them. In the pack was the forms that needed to be filled in so they could go through them with you at the meeting. I assume I had to go in as it was a creditors petition and my BR was also business related. The OR (lady) was lovely and not judgemental, but I was still relieved when I had got it out of the way! Please feel free to ask if you need any help.

    hi..regarding terminology?

    For a Court to declare an individual 'bankrupt', it must be satisfied that the individual concerned is in fact insolvent.

    In other words, after taking into account reasonable living expenses, an individual cannot meet their debts as they fall due.

    Insolvency is the process...bankruptcy is the end result of that process.

    In much the same way as divorce is the end result of a breakdown of a marriage....the dissolution.
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    but bankruptcy is insolvency,

    bankruptcy is infact one of a number of formal types of insolvency, you can as alastair points out also be informaly insolvent as in, being in a state where you cannot meet your debts

    And thank you for tour responses.

    Today I plucked up the courage to ring the courts to ask about my court
    date.
    I've found out who is making me bankrupt and apparently have missed two court dates so far. I spoke with the court clerks who advise I if I do not want to go, then send in a letter stating I have no objection to the ...... wait for it.........BANKRUPTCY!! Phew!! can't tell you I never thought I would want to hear that. But I need to draw an end to this.

    you are lucky as they have saved you £750, if you had to do it yourself..
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    The current cost of petitioning your own BR is £175 Court fees and £525 OR's costs = £700.
    When I joined, I needed a name. The forum members gave one to me...I am INAN :D
