Bank and BACs advice reqd pls

We have defaulted on our old accounts including banks and have a DMP with CCCS via our new Barclays accounts. Unfortunately one of my customers has transferred all her new bathroom deposit to my old account...

As I was £5k OD with them what can I do? I need the money to complete the bathroom and if I can't get it back I don't have any work!!!

HELP!:(

Is it worth phoning CCCS for advice? I'm sorry I can't help more than that; I'm new here myself and just learning. I hope you get it sorted.

No. Have tried them and all they say is call the bank.

I don't feel its sensible to call my old bank as I would imagine if they get wind it's for me they'll simply rub their hands in glee...

My thought is that it's going to be best if the customer just plays is safe and says they made a typo and its ended up in the wrong place pleading ignorance as to where it ended up!

The onus would be on the sender to play dumb and attempt to get the money back from the receiving bank stating the payment was sent in error.

However it can be along drawn out process if the bank are willing to help...... As its at the discretion of the receiving bank to send it back etc.

Was the payment sent by BACS or FP? (if sent by BACS when was it sent)

It was sent via BACs. I was going to advise them to simply say it was a typo when entering the information!

I agree they must play dumb tho.

    How long might it take?

I thought is was illeagal to keep funds incorrect credits?

It could take weeks or even months the banks are not obliged to help either im sorry to say.... Its a kind of tough cookie if its been sent in error.

    sent 27th Nov

Does that mean we've 'lost' it?

Yes it looks like im sorry to say BACS payments can be recalled within 2 days of them being sent. However to much time has elapsed now to explore that avenue.

You will have to ask the sender of the funds to contact there bank to try and retrieve the money from the recipient.

Possibly, as the bank would have used the money to reduce your overdraft.
