There's a PS to this.
Looking closely at the payslips for Xmas it looks like something worse is going on.
The payslips are numbered for each week. Say Week 37 for 15th December. Then there are two weeks he wasn't given payslips for. Not at all. He received no money at all for this period. Was told he wasn't due to be paid for holidays in the first year (yes, I know this is illegal but he didn't argue too hard for fear of losing his job)
The next pay slip has a much higher running total of total pay than the previous one he was handed. So it looks like the employer paid him. But he didn't.
I suppose this is yet another case of this was illegal but nothing u can do? He was always paid in cash, employer refused to pay via BACs so no proof he wasn't paid.
ACAS say this isn't within their remit. Is it within anyone's remit?0 -
Just as an update.., as this is the second employer to break the law re employment regulations, my OH is due to appear at an employment tribunal in January. I've done a lot of research so am a bit more aware of what is allowed and what is not as far as employment is concerned.
The case is on the basis that holiday wasn't paid, proper notice wasn't given when the employer dismissed him. The former employer has flatly refused to negotiate through ACAS, which probably won't help him. He's lied on his statement and in a letter in response to our formal complaint (which you have to do before proceeding to an Employment Tribunal).
I can't give too many details here.., I will after the case is over in the hope that someone else in the same situation will know their rights.0
