Business bank account still open.....help needed

I informed my business bank manager shortly after my bankruptcy was through that the business had ceased trading.

The account should have been closed.

An old customer has just tranferred some funds into this account by mistake and having checked with the bank, the account was still open. This was business he was pondering on doing with me a few months ago and had decided to proceed without checking with me first.

Where do I/he stand on this?

Speaking to the call centre they say that they cannot reverse the payment.

Surely if we have stopped trading and are bankrupt, the payment should not have been accepted?

There was a small overdraft on the account, which was included in the bankrupty, and this payment has put the account back into credit.

Any advise on how I approach this, as the bank (Barclays) do not seem to want to help.

    I would inform your OR of the situation. They should be able to write to the bank telling them to repay the money, they don't have to reverse the payment, just send a payment back.
    When I joined, I needed a name. The forum members gave one to me...I am INAN :D

  • Am I right in thinking that as soon as I informed them of the bankruptcy and that I have ceased trading, they should have closed or at least frozen the account?

    The bank are saying they could not close the account as it was overdrawn.

    All I want is for the former client to get his money back, otherwise this could get messy.
  • Can anyone offer any advise on this, as Barclay's have point blank refused to refund this money?

    Do I go to the Banking Ombudsman?

    Hi Bollotti, I'm not a 100% sure tbh. Until a poster advises further, have you spoken to BDL? They may have had heard of this happening before and may know the next step you need to take.

  • I have just spoken to the AIB (accountant in bankruptcy), they have said they will write to the bank and either have the payment made to them to forward on, or ask them to reverse the payment. It is not a route I wanted to take as did not want this former client to know I was bankrupt.

    I'm sorry your former client will know, but so pleased that the money will be returned.
