  • Hasn't this thread rather drifted from the point, though? I may have misunderstood but the OP said 'I had 3 weeks left to take when i was taken ill.' So as I read it, there are 2 separate issues:

    The accrued holiday BEFORE the illness, which no-one seems to have mentioned. THERE IS NO DOUBT THAT YOU ARE ENTITLED TO THIS!!!!

    Potential holiday accrued whilst you were off sick - the posts above seem to me to relate to this.

    So you may even be owed 3 weeks for the time when you weren't sick, plus some accrued holiday whilst you were sick :)

  • Where I work employees can accrue annual leave whilst on paid sick leave, but they can't receive pay in lieu of the leave.

    It depends on the year in which the annual leave accrued. Is it in the same year? If so, then there is no issue. Of course you are entitled to take it. However, if you have been unable to take leave because of sickness, it MAY not be so, but I shall check this 0ut.
