Christmas Day Working

Hi all

I have to work Christmas Day which this year falls on a Sunday but I do have off the Monday and Tuesday.

My company has decided to pay the double time to the staff that are working on the Monday and Tuesday instead of us mugs that are working Christmas day.

Lets face it no one wants to work Christmas Day but the double time at least makes up for it a little bit, but now I'm not even going to get that.

Just wondering what the laws are regarding this ? Does anyone know ?

  • There is no law giving you an entitlement to double time. What does your contract say?

    Unfortunately if your contract states double time is payable on a public holiday then you're not entitled to double time on Xmas day as it's not a public holiday. The NHS have done the same as well.

    The Monday and the Tuesday are the bank holidays if you have a job that works on a rota you get the rough with the smooth my DD has a shift pattern that runs 24/7 and some years she gets good days off and other she doesn't it all works out fair in the end.

    As others have said unless specifically stated in your contract then you will only be entitled to Sunday rate whatever that is.

  • What do you do for you to warrant working on a Christmas day (I'm assuming within retail?) The only things open usually are the off-licenses for people to stock up on more alcohol!

    lots of people work on Christmas day. nursing homes, hospitals, petrol stations, chemists, emergency vets and so on

    Call centres, security ... and of course, our armed forces. ;)

    We're in a similar situation except that we only get time and a half. Last time it happened we agreed as a team that those who worked the 25th would get the extra pay rather than those working the official bank holiday as we felt it was unfair otherwise - it doesn't even out over the year as we don't get extra pay for any other bank holiday. But that was a workplace specific decision and depended on the agreement of the whole team.
