What breaks is she entitled to?

My 17 yo daughter has just started a Christmas Job for approx 5 - 6 weeks. Her rota for the next 3 weeks she will be working different hours and total hours.
Week 1 Hours in work 22
Week 2 Hours in work 31
Week 3 Hours in work 37 1/2
What breaks should she be entitled to?
And would pay be deducted for the breaks?
How will she go on for paying tax and NI contributions?
This is her first Job since leaving school in 2010.
Thanks in advance.

Depends what hours she is working.
She should get a 20 minute break during each shift of over 6 hours.0 -
All depends on if they are over 18 or not:
Under 18: http://www.direct.gov.uk/en/YoungPeople/Workandcareers/Yourrightsandresponsibilitiesatwork/DG_174530
Over 18: http://www.direct.gov.uk/en/Employment/Employees/WorkingHoursAndTimeOff/DG_10029451If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

I had been on the site above.
She will be working shifts of 5 hrs, upto 8 hours. I assume on the 5 hr shift she will get 5 hrs pay and a break, but on the 8 hr shift she will get 7.5 hrs pay and a break of 30 mins.
What about Tax and NI? will they Tax and NI her on emergency tax code, and will she get this back in April if she has earned less than her Tax Threshold?0 -

17 Years as stated in the first post, maybe you overlooked it.
Ooops, sorry, looks like you edited it whilst I was writing my first reply, it said something about leaving school in 2010 when I read it
Anyhows...
For the 5 hour shift, she's entitled to a 30 mins break and will be paid for 4.5 hours.
For the 8 hour shift, she's entitled to a 30 mins break and will be paid for 7.5 hours
Obviously, it all depends on the HR policy wherever she is going to work, some will offer longer (or more) breaks and even different terms regarding paid breaks etc, but they can't be any worse than the minimum.
As for tax, yes she'll have to pay it and it will be at the emergency rate. The soon she gets a proper tax code, the better...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

I thought it was 20 mins break for a 6 hour period, and was thinking 5 hrs = 15/20 mins break and 5 hrs pay.
When or how does she get a proper tax code?0 -
Does your daughter want you looking after her in this way or does she want to be left to learn and experience working life for herself? She will learn to stand up for herself if you leave her to it. Just my viewpoint.0

Why are you mithering about it before it even arises.
Let her get on with it and learn from it. I had a baby at that age with no one but a husband around.
Some would give a break in the five hours and some wouldnt but she would not legally be entitled toa breakmake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
I would say that as she hasnt started the job yet and it's her first job she should see what actually happens, rather than telling her that she 'has to have' such and such a break if she works so many hours. If she goes in expecting breaks when she thinks they are due, then she could get herself into trouble. Nothing worse than a youngster coming in saying 'well I've worked for x hours I need a break!' We've seen some threads on here that say that and the OPs got shot down in flames!
A lot depends on the company culture and what she will be doing - so for example in many office although staff are entitled to an hour break, many people eat at their desks and rarely have a full hour.
Most companies do not pay for lunch breaks, however on a full week she would be at work for longer than, say, 37.5 hours with her lunch break taken in the middle, so 37.5 hours would be 9 - 5.30 with an hour taken in the middle of the day.0
