Maintenance payments

Hi

My daughter's ex partner was paying her child maintenance, through the CSA, for their two children. He has now lost his job and is unable to pay any maintenance. Can she claim any benefits to help with the loss of the child maintenance.

might be able to get Income Support depending if she doesnt work or does part time, but have a look at this site

Hi

No, she's not working. She is a single parent with three children aged 2, 3 and 5. She has housing benefit and council tax benefit.

I'm afraid she cannot. She would only be entitled to £10 of child support as she is on IS. If ex is in receipt of IS, the CSA should deduct around £5 out of his benefit.

I would also suggest she contacts the CSA regularly to see if he has secured another job.

Since maintenance payments are treated as income for housing benefit purposes, then if the maintenance payments stop, your daughter's income would be reduced and she may be entitled to more housing benefit. I would recommend that she contacts her Council to find out.

If he claims benefits, she would get the fiver that is deducted, not the full 10 pounds as he isn't paying it. She would only get UP TO 10 pounds per week in this circumstance. When he gets another job, then he can be reassessed and she would get 10 pounds then if he is assessed at having to pay that or more.

as she isn't working, is she not claiming Income Support?
