P45

long time lurker here.

can anyone help regarding the procedure for P45s? my previous employer keeps making excuses for not sending mine. do they have to by law? i'm on a stupid tax rate at the moment but my employer says they cant do anything until they recieve the p45

    Yes by law they have to give your p45 send them a strong email saying that you will report them to the tax office for withholding your p45.

    In the absence of a p45 your new employer should have got you to fill in a p46. If he hasnt already then do one now. They are downloadable.

  • In the absence of a P45 your new employer should have given you a P46 to complete and put you on Week/Month 1 until they get your correct tax-code from the Revenue. Please ask your employer why they have not done so.

    In the meantime you should contact the old employer and ask them to produce your P45 as a matter of urgency. Sometimes they won't do that until they have done the monthly payroll. How long ago did you leave your previous job and have they paid you?

    That is a stupid tax-code: if you are a single person it should be 725 or thereabouts. Look at it as a form of saving. Once your tax-code is sorted correctly you should get all overpaid tax back in your weekly/monthly pay.

    i've asked them a few times, i left 2 months ago and they've paid my last wage.

    i'll ask my current eemployers about the P46, i cant remember receiving one but i got a lot of paperwork at the beginning so maybe i missed it.

  • If you've only been contacting them by phone please WRITE and ask them for your P45. If they use a payroll bureau to provide the calcs they have to inform the bureau of every employee who starts and leaves during each pay period before they start doing it. Perhaps some numpty in HR has forgotten to tell them?

    i've looked through everything I got on my first day and cant find a P46, so i'll ask for one tomorrow. i'll also write to the previous emplyer as well because i have only phoned them up until now.

    Your employer would not have simply come up with a tax code like that so it must have come from somewhere.

    In the absence of a P45, a P46 should have been completed. Depending on how this was completed a tax code of 747L, cumulative or non cumulative, or a tax code of BR would have been used. In the absence of a P45 or a P46 then code OT would have been used. So this does not explain the 152T tax code.

    What tax code were you when you left your last job and how long have you been in the new job?

    Have you had a P2 coding notice explaining the 152T tax code?
