HMRC Claim I've under paid

Hi,

I woke up this morning to the pleasant arrival of a my P800 Tax calculations this morning. HMRC claim that I have under paid 2009-10 by £782. They've also sent a further calculation through for 2010-11, which adds a further £62 bringing my total underpayment to £844.

Looking at the 2009-10 calculation, they have my car benefit listed as £7637. So I have checked my P11D for a breakdown of this. I have found that my P11D for the 2009-10 period is broken down as follows:

£3907 - Car Benefit
£3718 - Fuel Benefit
Total Taxable Benefits - £7625

I have always paid for my Private fuel consumption at the rate set by HMRC through monthly deductions from my pay, and I pay tax through PAYE. I am also able to demonstrate this by way of all my pay slips, and mileage claim forms.

Would I be correct in thinking my employer has misreported my BIK to HMRC? If so can I assume it is unlikely that I have underpaid?

Any help would be appreciated

    1) That looks to be the case from your data

    2) Certainly - if you were paying some tax at 40%. It will reduce the underpayment by circa £745 if at 20%
    If you want to test the depth of the water .........don't use both feet !

    Seems to me you need to initially take this matter up with your employer and see why they have reported private fuel on your P11d. They will need to submit a revised P11d to HMRC.
