  • Hi Hidden (hope it is ok to call you that)

Just seen a link to your diary on another thread I use and thought I would pop on over.

I cannot believe that Payplan were so negative about getting your court payments reduced. I totally understand when you say that you would rather just keep paying them as they are as they will be finished soon but nobody should have to go without gas for most of the time and elec occasionally.

I help people all the time get their court payments reduced and it only takes a few weeks.

So if you do want to reduce them I will list below what you need to do (sorry if you don't want to do it but it might help someone else).

I got slightly lost when I was reading as you talk about court debt, fines and then arrears so if I have misunderstood I apologise.

I think the court fine you refer to was a fine for not having a TV Licence (or did I get confused??), anyway as long as it is a debt from a Magistrates or Crown Court then the same rules apply. If it is from a County Court then see below. I am not sure why the fine is set so high, in my area (and most of England - sorry if you are in Scotland) the minimum they want is £5.00 per week which can be deducted from your benefits. If you would like to get a fine reduced you need to contact the Fines Office of your local court and speak to them about it - they may sort it over the telephone or they might send you out a form to complete. If you do not like speaking on the telephone you could write to them.

You also mentioned a court order so I assume this is a debt which went to County Court (if it isn't let me know and I will give you more advice) for a Judgement. If you want to get this reduced you need form N245 which you complete and ask for a reduction in the payments. If you need help filling it in let me know. Normally you pay £35 if you ask for this but if you also have Form EX160a (form is last few pages of the leaflet) and proof of your Income Support dated within 1 month you just take it to the local County Court and they will look at it and it is usually reduced within a few weeks.
Some companies who have a CCJ against you will let you reduce your payments by just ringing them and not needing to go through the court.

You also mentioned rent arrears, are you a private tenant? How was the rent arrears figure arrived at?

I know of lots of organisations that help families in need so if you would like some support or help you could PM me your area and I will give you some specifics. I totally understand if you won't want to do that as you don't know me so for starters what about either Sure Start (which is mainly larger towns) and is centred around children's centre's where mothers can meet and attend courses while the children use the creche - it might help to get you out of the house? Or if you are more rural there is usually a Home Start in your area. This is where you are allocated a volunteer who will visit you once a week for a few hours either just talk or to help with the children or to take you out.

HTH (Sorry to barge in on your thread)

Im starting to think the same now, Even if it is only a few weeks its maybe worth trying becuase like you say it is difficult like this. I will look into this on Wednesday and pm you for help if I need it if thats ok? x

You also mentioned rent arrears, are you a private tenant? How was the rent arrears figure arrived at?

Yes, Im a private tenant, the arrears started becasue when we moved in she didnt want the month in front, just the bond and was happy to wait until the last day of the month for the rent. Now she wants me to be a month in front becuase Im on housing benefit now she said she needs the security, so I needed to pay her £550

I do have a Surestart, I just struggle with actually going out the house iykwim, I must change it in the New year its no good for me or the kids. So I will definatly be making more of an effort to leave the house x
