Santader/Shabbey ERC-claiming it back

I redeemed my existing mortage on my old house for a buy-to-let mortgage with a difference mortgage provider. The only downside was that I had to pay 3% ERC. However, it was indicated to me that if i completion on my new house was within 3 months and "ported my mortgage" deal across I would get this refunded. I have done so, and it is now 2 weeks since contract completion and I am still waiting.
My mortgage advisor (through advise from his santander consultant) has now said that it is up to my sollicitor to request this. It is acknowledged that this is unusal and it is normal for these types of refunds to be acted upon automatically.
How can I get my money back quickly? My sollicitor grudgingly has sent of a request by fax today.
Are they in breack of contract? Can i get change mortgage provider without ERC penalty as a result?
It would be interesting to hear other forum users' views? Is there a Santander Mortgage employee there who can point me in the right direction?

10 working days isn't very long. As your solicitor wouldn't have filed the paperwork until last week with Santander. So it would take time to be processed through the system.0
