Tax credits for NRP

NRP receives WTC and CTC as a joint claim with his new partner.
Should any of this be taken into account for maintenance calculations.
I called CSA but they were unable to give me a definitive answer, I will try later to speak to someone else but thought someone here might know?

Yes, it should.0

CTC yes, WTC depends. If he earns more than partner it's taken into account, if they earn the same then 50% is taken into account, and if she earns more than him then it;s not taken into account.0

He is the main earner.
CSA have confirmed that they are not currently taking any tax credits into account, and are going to write to him to ask to see his award.
Whose fault is this? Mine, for not asking? CSA, for not asking? Him, for not telling?
Can this be backdated at all?
(He got the CSA to backdate a change of circs for him that reduced his payments considerably)0 -

I'm not sure if it's as easy as pinpointing anyone at 'fault' as such. He will have been asked at the start of the case about his income, which would include wages and also any other sources of income. If he was receiving the tax credits at the time then they should have been used for the assessment, but tax credits always appear to have been a bit of a touchy subject.
I don't think that they're going to be classed as income in the new scheme.0 -
No, he was not receiving TC's at the start of the claim, but he was quick to call them to reduce his payments when he moved in with her ;-)0

But as a NRP surely it is his duty and a legal obligation under the current legislation to notify them of a change of circumstances...?

Well this is what I thought, I know he has to update them about his address etc, so would be surprised if he did not have to update them about this?
CSA seemed *very* unsure, so I think I am going to do it all in writing to them to be on the safe side.0 -

They always kicked up a stink with me if i never notified them of a change, even when i did notify them they never acted on it, in the start it was annoying, after the 1st few arguments, i used to phone, fax and send recorded delivery...! And they still say they don't/didn't receive stuff... Strange that as it is all in my data protection file when i applied for it...!0 -

I think that tax credits are essentially classed as a tax rebate, rather than a prescribed benefit, although I could be wrong.0
