Redundancy Rules advice

My husband has been notified by telephone that his job is under threat of redundancy. He is currently off sick waiting to have angioplasty.

It's between him or his 1 colleague with the same job role. The MD of the co has sais he wants it "done and dusted" by Christmas. Now I am pretty sure this is far too quick to be legal, but am obviously looking for any other opinions.

He has worked there 7 and 1/2 years, the company has about 25 employees (I think), and for the previous 3 quarters my OH has hit and exceeded all his OTE targets (he's an account manager, i.e., sales rep).

Any advice on what the correct procedure for redundancy is?

  • There is no specific timescale for consultation as there is only one potential redundancy. If it is between your husband and a n other then there should be a matrix with objective criteria against which they are measured. This could also be a question of seeing of one would like to volunteer. If the Company goes through this quickly, meetings with h and ano etc and pays in lieu of notice, it could well be completed before Christmas. If he is selected, he would have the right of appeal if he considers it is unfair or if he feels he is being discriminated against.

    Your husband would be entitled to 7 years redundancy pay (depending on age would be either 7 or up to 10.5 assuming no service under the age of 21) this is capped at £400 per week unless Company more generous. In addition there will be notice pay of 1 week per each completed year of service.

    This probably isn't the best time for him to be having to think about this, but the fact that he has been notified means that he is in the consultation period and consultation is a two way process. So he needs to find out what provisions have been made to consult with him, what criteria are being used to make the selection (so that he is able to contribute ideas and opinions) and consider whether he has any alternatives to the proposed redundancy. The fact that he is off sick doesn't delay or postpone the employers intentions in this regard, so if he has anything to say them this is the time that he needs to say it. I would start with asking how the employer intends to consult with him on these issues.
