Misinformed by employer about how much holiday I had left and pay deducted!

Hi, I recently moved on from a job after 2 years employment. I asked my manager how much holiday I was entitled to if I left on the 27th November. He emailed HR who calculated what I could take. We sat down and fit in the hours before my last day and still had 1.5 hours holiday to be paid to me in my final payslip. (It was my decision to take the holiday rather than be paid it all after I left).

Although, in my final payslip I was deducted 4.5 hours holiday stating that I had taken too much holiday. Where do I stand with this?

  • firstly you need to calculate how much holiday you took and ask them for a breakdown and then go from there.

    However, ultimately your holiday is your responsibility and you are partly to blame as well.

    If it is right, and you have taken too much, then I doubt there is much net effect - you have left now anyway, and been paid what you are owed.

    Calculate it, and if they are indeed right, then nothing more you can do.

    I will have to ask them for a break down of where I took my holiday throughout the year. My manager's computer is sync'd with Head Office databases and keeps track of how many hours we have taken and how much we still need to take. I had about 23 hours to take if I worked until December, so when we read the email saying I'd have about 18 if I left at the end of November, I didn't feel any reason to question its accuracy.

    Is it possible that you only earn holiday for whole months completed? If so you wouldn't have earned any for November as you left on the 27th rather than the 30th. [Or it could be earned weekly but still have missed out on some for not completing the month].

    Did you not take some holiday dates and forget to inform the person who enters them on the system?

    You need to check what you took and what they have entered.

    holiday is not accrued monthly, you start to accrue it with every hour/day/week worked.

    That would be unlawful, at least as far as statutory holiday is concerned. The firm could apply that rule to any holiday entitlement in excess of 28 days.
