Actually didnt mean to leave it there! only just realised. Basically said how the purpose of the meeting was to discuss the : failure to comply with company policy, and a breach of safety rules and regulations. And says on numerous occasions I have been seen on site (false) and driving, without wearing a hi-vis jacket. And that this is in breach of company policy and safety regulations, which have been given to me (false). It appears that numerous means 2. Then there is a page from my boss indicating what was said when he questioned me on it, and my response of it being too hot.0

No there is no "gross misconduct", just that it breaches health and safety, and company policy. Just been scanning HSE website and nothing on there about it.
You won't find anything on the HSE website because contrary to popular belief the HSE don't determine what policies should be in place to that sort of micro-scale. It is up to individual companies to assess their own risks, determine what they think are safety measures, and implement them.
Similarly, forget trying to justify why they require all drivers to wear high-viz jackets. You are not going to get anywhere trying to criticize their policy.
What you need is the company policy on driving. This will be part of their health and safety policy which all employees should have access. Get a copy of this document and find out what it says. Next, find out how this was communicated to you - was it part of the induction training, was it issued by Email, did they give you a copy and you left it at the bottom of a drawer? If you have genuinely never been told about the requirement to wear high-viz jacket while driving then raise this at the disciplinary meeting.
If you have been warned about it before, however, then it is unlikely that you will be able to argue that you were not aware of the policy. In this case, your best course of action is to admit it, apologise and promise to wear it in future.0 -
Ok so I have taken on board what you guys have said, and thanks for helping. The thing I find most stupid, is that a hi-vis jacket is exactly that, "high visibility" so why on earth do you need to be "highly visible" while sat in the cab of a van? nonsense really.0
