SSP lenght

Hi guys,

I am not sure I understand the lenght of time employer has to pay SSP for...

The employer operates company sick pay of 12 weeks, which is higher then SSP.

Do they then have to pay 28 weeks of SSP, or is the 28 weeks for the whole lenght of sickness? ie 12 weeks at company pay and only 16 weeks of the minimum SSP requirement?

    Your company sick pay includes your SSP - the employer claims the SSP and "offsets it" against contractual sick pay. And it's 26 weeks - six months SSP.

    I thought SSP was upto 28 weeks?
    That's also what direct.gov says, has this changed?

    You may be correct - I don't deal with SSP but thought it was six months, and then went to ESA. But it is corect that SSP offsets contractual sick pay.

    Assuming that there is no earlier linking PIW (ie a sickness counting towards SSP that falls within eight weeks before the current sickness) then SSP is payable for 28 weeks but is not paid for the first three qualifying days of the PIW. So if you get SSP for Monday to Friday then it would end after you had been sick for 28 weeks and 3 days.

    Any company sick pay you recieve, provided that the payment for each day is at least equal to the SSP due for that day counts as the employer having paid SSP for that day. So if your employer was paying company sick pay from the first day say for 8 weeks,and this was a new PIW then, when 8 weeks had been paid to you they would be considered to have paid 7 weeks and 2 days SSP.

    In most cases SSP is paid by the employer it is only reclaimed and then usually only part of it when it is a large proportion of the wage cost for a month.
