Not being paid by previous employer

Hi I hope someone can help because im going out of my mind here.
I recently worked for a sales company,i worked there 3 weeks and only got paid for 1 week.Ive spoke to my boss a few times and he says hes not been paid by the people that pay him so therefore he cant pay me.There are a few of my friends that are in the same situation as myself too.The problem is as the role was classed as "self employed"(just an excuse for my employers not to put people on the books I think)I dont think there will be any record of me working there!Looking back I should have realised that things were not as they seemed but I was eager to get out of my current job and my friends who already worked there had no problems with pay before.
ANY advice would be appreciated thanks.

    What were the agreed terms of payment, and do you have this in writing? Was it commission only?
  • It wasnt commission,it was £50 per day no matter the amount of leads

    Invoice them, give 14 days for payment, if no response then make a civil claim via the small claims process.
    Their cashflow is not your problem.
    No free lunch, and no free laptop ;)
  • Thanks macman.Ive been in to Citizens Advice and they told me basically the same thing,only they said if they dont get back in touch with me within seven days I can take them to a tribunal.

    Did you tell CAB that you were self-employed? You won't be able to go to a tribunal I'm afraid.

    Follow Macman's advice above. You can lodge a small claim online these days I believe.

    Correct-you can't take them to an Employment Tribunal, because you weren't employed by them. Your only resort is civil action.

    Just because someone say you are self employed it does not mean you legally are.
    they are certain criteria that must be met before you are self employed.

    And equally to be employed. Thid was clearly casual work, not employment.
