Notice on probation periods? Anyone?

I can't believe tonight has happened. Bear with my story!

DH got a job in a call centre back a few months ago, and a team was created with all the applicants.

The probation period was 3 months, and everyone in the group had it extended til further notice.

One by one the team was dropping like flies after this. The team manager would advise the staff member of a review meeting, and then that staff member would never been seen again.

So when hubby's manager told him yesterday "your review is tomorrow" we kinda gathered what was likely to happen...

Except it happened in a way I still can't believe

Hubby went to work and the team manager was off sick. He was still concerned about his future and got to speak to the team leaders manager (we'll call her Boss)

Boss said he'd need to wait til tomorrow.

Later he felt the need to grill her as she didn't sound positive, and he wanted to know if it was even worth him driving 45mins in just to be told to go.

He asked her 4 times. She said nothing.

He logged on to the companys internal holiday applications, and it said he had zero holidays. :/ it all fell into place. He told the Boss she had 4 occasions to tell him and he wasn't hanging about to be treated like that.

He got home and opened his mail. There was a letter from HR written last Saturday, saying his team manager had confirmed his leaving date. The whole letter was written as though he and the team manager were aware they were letting him go.

It also said that his last day was in fact, last FRIDAY.
But he has worked Saturday, Tues, and today and no-one (including his team leader) told him anything, even although they've been sat in the same room??!!

Surely this isn't right? Does an employer need to give notice during a probation period? And the whole arrangement is just awful?

  • 1. They must actually give him notice - and the notice only applies from when they give notice, not from some date in some letter which refers to some meeting which did not happen.
    2. In his situation, I believe he is entitled to a week's notice

    Unless a longer period is specified in your contract, I believe statutory notice would be one week.
    As you have worked and only just received notice, then I believe the week starts from the day AFTER notice is given. However ... does the letter actually state that employment is terminated, or does it simply refer to the meeting that never took place? If it doesn't mention the former then you could technically go in for another day ... or more ... until they give notice of termination.

    They have gone about it in a rather underhanded manner I must admit. Sounds more like they just needed to fill a gap for something ... or maybe they do this frequently?
  • They must do this regularly, it's a massively known UK company.

    The contract says
    1. PROBATIONARY PERIOD:
    The first three months of your employment will be a probationary period. At any point during your probationary period, either you or the Company can end your employment by giving one week’s notice to the other in writing.

    It may do but notice begins THE DAY AFTER it is issued so if seven days from then takes you beyond the 25th November they will have to pay for those days.

    Don't forget to make sure he gets paid for all outstanding holiday which continues to accrue during the notice period.

    But as I see it, he only got notice today and they let him continue working.

    So if the letter never came he still would not have been put on notice.

    so still have a week to work and accrue more holiday
