Advice need please

Ok my step daughter has been living with us for about 8 weeks now and her mum still hasent signed over the child benefit we are getting a bit tired of her draging her heals now and we want everthing sorted, if my partner told her straight that we want the child benefit or we would report her would she be able to turn around and take my step daughter back and we would have no say,or becasue we have had my step daughter for so long now that we have a say in it?

I hope someone can give me some advice on were we stand :) thank you for any help you can give me
if this is in the part than i am very sorry.

  • Hi, I know someone who works in Child Benefit. I will ask for you. However, I need to know if this is a legal arrangement - has your step daughter moved in with you legally or is it a casual arrangement and she can go back to her mum at anytime?

    Her mum agreed to her living her but nothing legal was signed,so really her mum still has custody,well i think she does im not sure how it would work because she agreed to her living here.
  • I spoke to my friend who used to work in Child Benefit and she said that if you contacted them, they would stop the payments to your stepdaughters mum and demand the monies back if she had received them. You would then have to claim independently for her living with you. HOWEVER, before she left her job some rules and regulations were changing, so she advises that you ring and try and speak to someone about this situation 'hypothetically' - so you don't have to give names and addresses. As far as what she might be able to do with regards to removing your step daughter from your home, she advises Citizen Advice Bureau as she knows they have helped other people in the past in similar situations. I am sorry I cannot help you with what you originally asked (I was hoping I could), but I hope some of what I have told you will be of use. Good luck and sorry once again.

  • You need to contact the child benefit centre yourself and put your own claim in, although in order to do this you will need a copy of your step daughters birth certificate to send in, they will then contact your step daughters mother in order to resolve the situation, child benefit can only be backdated 8 weeks ( i think!?! ~ so don't quote me on it) so you should put your claim in asap. You will also need to consider claiming tax credits too.
