I have had Equidebt chasing me over a debt of £3,022.60 from Royal Bank of Scotland
I sent them a letter a couple of months ago (Recorded delivery) saying that it was statute barred. They ignored this and sent me another one last month, telling me how they would accept a reduced amount if I ponied up.
I sent them another letter back reminding them that the debt was STILL stature barred and I even enclosed a copy of my original letter to remind them. I got a letter this morning in a plain white envelope marked "Private & Confidential".
Upon opening it, it was the usual headed paper and was rather amused to read the following:
"We have investigated your account and can confirm that the debt is statute barred. However, please note that although this debt is unenforceable, you do have a moral obligation to repay the outstanding balance. We are prepared to accept reasonable and realistic installment proposals; please contact us on etc etc to work with you to reduce your indebtedness. We trust that this clarifies matters and look forward to your response"
Oh how I laughed, I am sorely tempted to send them a Christmas card with "PS - I am morally bankrupt" on the bottom

Laughable indeed, I really wonder how many people who have gone to the effort to understand the limitation act and send out a letter to say its statute barred would actually then pay up on receipt of a letter like this.
That said - I'd report them to the OFT and trading standards and consider a formal complaint as post #4 of this thread http://forums.moneysavingexpert.com/showpost.php?p=34906247&postcount=4A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks OP, that brightened my day.
A DCA giving advice about moral behaviour. :rotfl:
That is absolutely priceless!0 -
They are right in what they say. Which makes it all the more laughable.0
