If employer failed to pay over emplyee deductions or keep P11 record.

I uded to work for the HMRC !!!!! but that was nearly sixteen years ago! Then IIRC there were regualtions and procedures that protected employees, giving them credits for monies deducted from salary under situations such as that given below.

A friend worked for a company that wnt in to liquidation towards the end of 2009/10. Recently he has been informed that only one or two months' NIC deductions have been credited to his record for the year. He has shown me his tax papers which give no memtion of NICs. He does not have monthly pay slips.

I suspect that, if the P11 is not with the liquidator's papers, proper records were not kept by the emploer and/or employee deductions were not paid over.

That being the case what can my fiend as the ex employee do to obtain relief from having to pay again what he gas already paid.

Sugestions with any relevant rederences will ne much welcomed,:)

    There are still procedures in place regarding missing contributions. Your friend needs to contact Employer caseworker, HMRC, Longbenton, Newcastle upon Tyne NE98 1YX send them all the information on what has happened, and P60's if your friend has any, then Employer Caseworker will look into it for your friend.

    Provide his payslips showing the NI deductions! Why would he not keep them - at least until he had a P60?

    @MY From expereince I know that too many do not realise the potential value of those pay slips, at least the latest one if it records cumulatives. I'll get him to thinl if he does have them tucked away somewhere

    You would be suprised how many people do not even open their payslips, money is in the bank and everything is rosy. When I used to check lockers to give to new employees it was amazing how many payslips and P60's I found.

    the problem is employers on the bring of going under tend to be a) often late with salaries, and b) tend to 'forget' about the issue of payslips.

    It's a common thing in my experience that when a company has closed the individual has had no payslips for x amount of months/weeks, and is owed vast amounts of money by the employer.
