Paperless office for a debt recovery agency

I'm being pursued for debt by a recovery agency who claims they have a paperless office. This means that I can't send them letters so I can't send them a CASHFLOW statement as it's a PDF file. The only way I can send them information is via a website contact form which gives me no record of what I have sent them. I can't e-mail them back as you can't reply to their e-mails. I've spoken to someone today who said I could fax them my CASHFLOW statement from a local library. This seems very unfair as I have said to them that I wish to be communicated with via letter or e-mail only.

Does anyone know if it's fair or legal for them to be a paperless office?

    What's a cashflow statement? Is it like an income and expenditure list?

    It's a way for people who have had advice from a money advisor to produce a financial statement. Creditors should treat these in the same way they might one completed face to face with an official advice service.

  • Ask them for their registered office address as listed with Companies House and their trading address.

    They want a paperless office. That's nice for them. You have every right to communicate by post - they cannot legally prevent you from utilising a system that enables you to keep a proper record of communication. I would take the precaution of getting a 'Signed for' service at the Post Office though.

    Use their system to make the request, and note that they must provide you with a specific email address or a postal address for you to communicate with them, as Data Protection entitles you to request that that a named individual handle your account and that your cofidential information not be sent to a group mailbox.

    The ICO tend to look quite negatively at these actions.... worth a shot anyway.

  • Log a formal complaint with them, if you can figure out how :)

    If you ring them, tell them you want to make a formal complaint and ask them to tell you their process.

    I would also report them to the OFT for unreasonable behaviour, as I think they would consider it unacceptable for a DCA not to accept letters.

    Egg loans tried this with me, but funnily enough, they managed to respond to my complaint letter.

    tell them you a a moneyless office, and that should they will to contact you to write to you.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    They're saying this in order to prevent receiving post they don't want to acknowledge - like CCA requests, dispute letters, statute barred letters, etc.

    Just because they say they don't accept mail is neither here nor there - you correspond with them how you see fit, and it's not up to them to dictate it to you.

    And dealing with it in writing is the best way - remembering, of course, to send correspondence via recorded delivery (DCAs have a habit of denying receiving mail) and not to enclose signatures of any kind.
  • What EXACTLY did they say? 'we are a paperless office' or, 'we would prefer etc' or was it actually 'we refuse to accept anything you send us in writing and wont even read it'? Big difference.

    I find your statement a little hard to believe as all CAB's send letters and a DCA refusing to accept them would be in big trouble.
