I think you should be glad you got refunded. I've never heard of the site and looking at it and the fact it is based in the BVI I would be reluctant to give them my credit card details in the first place to order. When even credit card details of large companies like TK Maxx go walk about, it makes you think twice.0

I believe Empire were offering a free copy of Borat with a new subscription. If you like film magazines I guess that would solve your problem, and it's not particularly expensive either.

Couple of points.
Contact may not have been formed because the goods were not dispatched (but as the company is foreign thats not really relevant)
If you did try to sue them (for what reason I have no idea, as to attempt to sue someone on a point of principle is really stupid unless you're really really rich or really dumb) all a judge would look at is whether things were set to rights, which they were when the money was refunded. If I were sitting in jugement I wouldn't award costs, as sueing someone over less than £6 could be seen as a waste of the courts time.0 -
I don't agree with either of your two points, ohdearme.
Clearly goods don't have to be despatched for a contract to be binding.
And refunding your money does NOT "set things to rights" due to the "loss of bargain" involved. "Setting things to rights" involves refunding you enough money to buy the item elsewhere at the cheapest available price, which may be more than you originally paid.
In my legal case, my supplier had NOT charged me but a contract had been formed; they paid me the difference between their price and the (significantly higher) price elsewhere to avoid going to court.0 -

You should agree with his first point, the one I myself made a while ago. The company is foreign, UK law is precisely that, applying to UK companies.0 -

On what grounds? Why on earth should the company stump up the difference so you can purchase the item elsewhere? Simply because the company in question decided not to honour the original price?
This is all pointless anyway as the company is Singaporean based so you do not have a leg to stand on even if the customer wanted to pursue this.
Nearly everyone that has replied to this thread seems to have far too much time on their hands kicking off about such small things, I mean if the company took the money then decided not to send the product and pocket the money then that would be wrong but no injustice has been done here.
I know for a fact that if this happened to me I would say "damn it, lost out on that bargain" then forget all about it, as long as my money was reunded who gives 2 hoots???0 -
