Employee pay

Hi wonder if anyone on here knows about pay for employee that is receiving state pension. In contract it says that the company SSP but when employee is off sick the amount that he should have paid by why of NI was deducted from pay.

Anyone able to help with this would be much appreciated, no good asking employer HR as they say it is correct. :beer:

If are on state pension you don't pay NI on your wages.

Could you reword your second sentence; I'm not sure what you are saying, or asking.

Thanks for reply, employee should have to company pay as in contract while off sick, but there was deductions in company pay for sickness absence and do not qualify for SSP.

Sorry should have made myself clearer, should he have got full company pay without deductions.

Please write out in full what it says in the written contract about entitlement to sick pay, both statutory sick (SSP) and company sick pay if they pay company sick pay.

I suspect they don't pay company sick pay and the statutory scheme does not pay until the fourth day of sickness.

I think you are saying they are deducting NI, but you should not be paying NI so there is nothing to deduct

Surely if you are on state pension you wouldnt get SSP nor would you pay NI

So if you are a pensioner and are off sick then the only thing you would get from your employer is company sick pay if applicable.

I believe there is no age limit on SSP, due to age-discrimination laws, so receipt of a state pension does not have an impact on eligibility.
