The State Pension is, unlike most things under PAYE, taxable when entitlement arises. Not when paid - if the two are different.
    - what does this mean?

Ignore it - it has no material relevance to you.

Then the State Pension total to the date of death.
Does that mean, all the state pension my Dad ever received, or just what he received in that tax year?
    Just the tax year 10/11

We did actually complete an R27 shortly after Dad's death,

So was there a refund made to the Estate after HMRC processed it? And do the figures you / the executor provided on the R27 tie up with the computation HMRC provided as a consequence. More importantly do the figures HMRC came back with - tie up to the P800 for 10/11?

  • Thanks everyone, we've noted down these points of information. It looks as if the HMRC are repeating the same error they made in 2009/10, i.e. asking for the same amount again - but we can't really tell at this stage. My mum has asked them to clarify and they're going to respond 'in three weeks', so we'll see how they get on.

Thanks in meantime for your help.

Sorry but this last bit is wrong really ?
In normal circumstances, yes customers are directed to the helplines in Enquiry Centres. However Enquiry Centre staff it depends who you get on the days know the difficulties the bereaved have in dealing with their loved ones tax affairs and realise that a face to face appointment is usually the best option for ensuring everything is sorted with the minimum of pain and fuss.

Just so you are aware of how incompetant some of these people are here is my experience with a tax enquiry centre:

I had a new tax code in April that caused a large increase in my tax payment as I get a bonus 4 times a year it took a couple of months for me to realise that after a reasonable pay rise I was worse off than last year. I rang the tax office and they said they though I had underpaid tax so I asked the guy when they would know either way, he umm'd and ahh'd and admitted he hadn't a clue, I asked why they though I owed tax ( when they had given me a substantial refund for the tax year in question) he didn't know. I asked him to find out and write to me with the information, I got another better (for me) tax code and I'm £200 a month better off. They were taking £200 extra a month as a precaution that I might owe the tax on £1600 but they couldn't explain why..

It should be fairly clear if you post the 10/11 P800 data? And that shows an overpayment / relative balance for 10/11 ....... but an 'Adjustment' at Section 'C' which is the same as the 09/10 figure you suggested had been settled?

In what way does that make the tax enquiry staff incompetent? And why - with a restriction of £1600 you didn't agree with - wouldn't you appeal the Code when it arrived in Feb / Mar?

I didn't say that issuing a tax code made them incompetent did I?

The fact that the guy on the phone didn't know whether I had an underpayment and if I did what it was for or when it was from made him incompetent however quoting that bit of my post is obviously not good for having a go;)

Not the intention. But why - when there are 3 separate posts suggesting / inferring the OP contact an enquiry centre - introduce a post containing 'incompetent' and 'enquiry centre' in the subject line.

And if you dealt with it all on the 'phone ...... you went nowhere near an enquiry centre. They're 'face to face' only.
