remove a default advice please.

I am in the process of trying to remove a default that was added to a store card account this year.
I cleared the debt immediately as it was only a couple of hundred pounds mainly made up of late payment charges and not purchases. I have recieved a sar and that shows the agreement 2009 had not been signed by anybody does this make it invalid? please if any one knows anything i can find on the sar to help get it removed. thankyou.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • within a couple of weeks of the mortgage advisor telling me it was there. I missed 4 payments not realising there was late payments on it as i was a bit stressed at the time, but the sar shows they sent default notice to my old address by mistake even tho they were useing my new address on file. sorry if that sounds complicated im just trying everything now as it was only for £150.
  • A default being registered has nothing to do with an account being unenforceable. Even if irredeemably unenforceable the debt still exists they just can't pursue you in court for it.
    If the default was correct (ie you were 3 months in arrears) and failed to remedy the default (ie pay the arrears within 14 days) then it's a totally valid reflection of your account running and they have the right to do it under the consumer credit act and you'll be lucky to get it removed.
    However, if it wasn't served correctly, ie to the wrong address then you could potentially argue that you weren't given the chance to remedy it. Worth a shot...
