Data protection what are conditions?

Hi,

I just wanted to make an enquiry relating to data protection. It is in Ireland although I am sure the same rules apply as England.

I recently filled out an application form for a birth cert at a registration office. The form asked for my name and postel address which I put on the form.

I would be interested to know how long are my details including my name and address held on file. Is this info processed in some way. Can the registration office share my personal info with other departments or people.

The form did not ask for a signature or there was no consent declaration or anything like that. I just printed my name and address on it with a pen.

Be greatful for any input.

    Were you applying for a copy of your own birth certificate?

    Please don't tell the Irish Government that their rules / laws must be the same as England. The last time the Irish were told that they got very annoyed. The laws are entirely different.

    However, the Data Protection laws should relate to the European Data Protection Directive 95/46/EC as for the UK. Of course, local incorporation could produce different fine-tuning!

    The data protection laws look to be pretty much the same.

    So can anyone tell me can a form with my name and address be shared with anyone else. As I said on the form I did not sign it just printed my name and address with a pen.

    There also was no consent declaration. It was a birth cert form also just asked for parents names.
  • Why don't you ask the Office of the Registrar General?
    What are you worried about?

    My personal opinion (opinion based on my experience of how the world works but with no knowledge of the law in Eire) is that your name and address will be kept by the Office but there is no reason to share with another government department as a matter of routine.

    The only reason I would see for sharing would be if a person with your name appeared to be involved in a fraud which required the production of a birth certificate and the Office was asked whether someone had ordered such a certificate.

    Sorry - but there must be a thousand sources of your name and address. Who are you worried that they will share it with? And why? Because whatever the dtat protection laws, they are never absolute. data can be shared and/or seized for a variety of reasons - generally to do with the law.
  • I am doing some research on family, and I suppose I don't really want to have it on record that I obianed a birth cert of someone else.

    So that is mainly my concern. I did email the office but did not hear back yet.

    No it was a copy of my own Birth Cert in the Rep of Ireland.


    So was it your own birth certificate or somebody else's?
  • My own and others,

    I mainly just wanted to find out the rules on data protection, and don't like the idea of people having my details or being able to access my details. I have had bad experiences in the past.

    And don't like the idea of having my information freely available to others upon request.
  • Well as far as I can remember, your name and address aren't covered by the DPA as they're not exactly personal information. But you'll probably be protected by a client confidentiality policy
