Robinson way ltd

Hi Folks,

Wondering if you knowledgable folks could give me some advice/guidance. Been reading this forum for many months now but this is my first post!

Very recently, Ive started being harrased beyond belief for a very old debt via Robinson Way, at least 2 letters per week! Im just about to send them the prove it letter to get them to stop hounding me but it made me wonder what damage they are doing to my credit report so Ive just checked.

There is a default registered by them on oct 2006 however the debt was an old Capital One credit card (registered 2003) so can robinson way register a default against me if the original debt isnt actually theirs?

Also should this now be statute barred? (im in scotland) If so, can I have this removed? Also could this be the reason whay Ive suddenly started being bombarded with vile mail from them? A last ditch attempt to collect so to speak?

    They can register the default in their own name if they have purchased the debt. However, they cannot change the date of the original default.

    When was the last time a payment was made toward this debt??

  • I honestly cant remember its been so long. I hadnt had any correspondance from them for years untill very recently.

    No written acknowledgements of debt made after that date, and what month in 2005?

    If it's over 6 years, then it's statute barred - meaning you could feasibly ignore any correspondence from RW or anyone else regarding the same 'debt'.

    Isn't it five years for statute barring in Scotland. Often they will send a flurry of letters before the barring kicks in just so you might cave in - ignore them!

    You can, but if you choose that option, make sure you don't sign the letter and send it recorded delivery.
