Bailiffs letter for son's parking fine

    ma,b,,you need to ask your son this,,, has he recieved 1)a PENALTY charge notice or 2)a PARKING charge notice,,,,if the answer is 2,,,its a scam,,get him to post on here if need be.
  • If you look at Marsdens they are a court appointed 'enforcement agency' http://www.marstongroup.co.uk/ and as the OP said their son got a ticket from Salford Council it does look like it's a genuine penalty charge rather than parking charge,

    Councils.. well its easy for them as they're covered by law and can literally pass it straight to a bailiff without involving any court.

    They cant! It goes from the council to TEC who then issue a county court judgement [which is not registered as such] Then if you don't pay it goes to enforcement, which is when the bailiffs become involved. Hence why it was said earlier the OP's son must have ignored or not received a lot of correspondence!

    Plus the bailiff jacks up their charges with supposed letters and visits!

    The 3 months in prison is interesting!:o

    No it goes to the Nottingham County Court where its then registered as a debt. There is no CCJ. While this all sounds very formal and you'd imagine a judge being involved, its not. It's a pretty streamlined process because there are so many of them.

    Apologies if I didn't provide enough info before, it's been a couple of years since I've been in the public parking enforcement role and you forget to put bits in. It's also possible that it may of changed since but this was the procedure the last I knew of it.

    OK if this is a local authority PCN it will have gone through the traffic enforcement centre (TEC)

    the warrant of execution should have his previous address on it (yours)



    What needs to be done is that the person needs to contact the Traffic Enforcement Centre on 08457 045 007 and ask them to send the form. TE7 and TE9 This can be sent by to them by e-mail.

    I would agree that bailiffs advice online is the way to go with this they will help him fill out the forms
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    That'll be Northampton County Court (actually the Traffic Enforcement Centre) then.

    @Ma Boswell. As Marston's will almost certainly have your address for your son make sure that you do not allow the bailiff access to your property at all. If he comes to the door talk to him through the letterbox or better still a first floor window. Do not let him in - even if you allow him in just so he can "discuss the matter more privately" he could subsequently force entry - not something you will want.

    You might also want to advise your son to get his car off the road - preferably into a locked garage out of sight at an address where the bailiffs are unlikely to look for it or better still do not know.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Northampton? MEmory must be letting me down lol. As for the TEC name... well.. same difference imo. Still goes to the court.
  • Hi everyone - just to thank you all for your kind responses and let you know that son has dealt with the bailiff - he had to pay up as it was a Council ticket, but he managed to get the Bailiff to agree to waive some of the charges and he got a proper receipt etc. Most importantly he learnt a valuable lesson about not ignoring things in the hopes that they will go away.
