Hi,im hoping someone can help.
I recieved a letter from BC&W asking for £400. It states that if I pay Immediately I will only be required to pay £200. I know dont have a debt in that amount, and it doesnt state who the Debt belongs too.
What should I do? I will not be calling them, but I am wondering if I should write to them.
Any help would be appreciated.

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
We would point out that we have no knowledge of any such debt being owed to The Loan Company.
We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
We look forward to your reply.

So this is just a fishing letter?
They have some bloody nerve! I checked all my bills and I cannot find one in the amount they requested. I did get a call from them this morning, but I just said " no speak english" and hung up. 3 more times they have called, but I think they have given up for today.
If I do send them a letter, wont I just get even more mail from them demanding money??

Is the debt shown on your credit file?
TO offer a 50% discount off the bat suggests it may be Statute Barred.0 -
IMO BCW are total scum. You are right to not call them!
Do as Chippy suggests and then forget about it. You do not owe the money, there is nothing they can do to you.
If they continue to pursue you without proof you owe the money then that is harassment and you can take legal action.0 -

Well I did check and the bill is from the end of 2004. I could have sworn I paid it years ago, as I never any letters from the debtor asking for money. And would it be Statute Barred by now anyway, even if the debt wasnt paid?:mad:

You could send them the statute barred letter (but remember not to sign it, and send it recorded delivery).
The onus is then on them to prove it isn't statute barred.
The thing to remember is that if it has ever passed the statute bar 'deadline' (6 years in England, 5 in Scotland), then nothing can 'un-bar' it.0
