    No doesn't xmas 2012, the days I work coincide with xmas day and boxing day so only need 0.5 day hol for 27th. No not on hol now, at work next week then break up for mat leave. Have used all 2011 hol leave

    So do you get BH on top of the 18 days

    That would be 44 days for full timers.

    You could use 2.5 days and have next week off.


    What are the contactual arrangments for holiday, with this amount it will be important.

    18 days contract. If a bank hol, xmas eve or new year eve falls on my "working" day then I get these paid "off" but if they fall on a non working day I don't get a pay/ day in lieu - for example, If xmas is on a Mon, no difference to me as I don't work Monday. But I'd get boxing day off paid as I normally work Tuesday

    I generally don't benefit from a bank hol as I don't work mon/fri

    It wouldnt work out at 44 days for a full timer, the mistake you are making is treating 2and1/2 days as half the week thus only half the entitlement when in fact its 3 days but one of them is a half day.
    This works out 3/5 of the minimum entitlement of 28 days (29 next year due to queens birthday) which equals 17.4 days rounded up to make 18. 12 of which will be full days and 6 half days which must be taken as half days and cant be added together to make full days.

    I hope this makes sense, im a little tired.;)

    Hey . . .

    Got my contract out - this is what it states:
    "You are entitled to thirty (30) days' holiday during each holiday year. This entitlement is based on a five day working week. If you work less than five days a week, your holiday entitlement will be calculated accordingly on a pro-rata basis (e.g. for a three day working week, the total annual entitlement will be 18 days holiday). In addition you are entitled to take the usual public holidays in England and Wales and such other days which the Company may from time to time recognise as paid public holidays. You will be paid your normal basic remuneration during such holidays. If your employment commences part way through the holiday year, your holiday entitlement during your first year of employment shall be calculated on a pro-rata basis, rounded up to the nearest whole day"
    I generally dont get to benefit from the Public Hols as these fall on Mon/Fri which i dont work.

    Just wanted to check something that Paddejohn said - I have never ever had to take 12 "full" days hol and 6 "half" day's hol.... ??? .... They allow me to basically take whatever days i want - So if i wanted 18 "Full" days off I could . . . or I could use the whole entitlement as 0.5 days ... Is that right?

    There has never been anything about Maternity in any of my contracts either as usually been separate documents that can be amended when law and practice change.

    OK full timers get 30+8 bh

    You should get (working 2.5days) 1/2 that so 19 days including BH.

    The policy says you should get 15 + BH ( but that could be under the statutory)

    You seem to get 18 + any BH that fall on a work day(that will always be over prorata)

    Back to the carry over.

    How far apart are you on how much to carry over.

    I think you could try for taking all your statutory 14 inc BH that would leave 4-6 depending on the Xmas/Boxing day to cary over.

    I think the employer could try for just the 20 day prorata, so 10 leaving 8-10 to cary over.
  • When i go back to work in Sept 2012 I will have 18 days holiday to take before 31st Dec - Plus I'll have BH's - Xmas Day and Boxing Day

    I will use 0.5 day's holiday for the day AFTER boxing day leaving me with 17.5 days to take from Sept - Dec.

    Boss hasnt said how many he wants me to carry over - Just that he doesnt want me taking all the hols between sept and dec.
