    Failure to have childcare in place is not an emergency.

    Failure of the childcare(say childminder is sick) is, but no backup is not an emergency after the first event.

    Yes - up to a point.

    First of all there is no hard and fast definition of an emergency. No two situations are exactly the same and we all know how lawyers love debating what is reasonable!

    Secondly it is very difficult for a firm to enquire into the details of the situation. If the employee offers a reason that (sort of) fits the bill you are going to have to work quite hard to disprove it, particularly if it has not been a regular occurrence so far.
