Lloyds TSB

I used to have a LloydsTSB current account that I opened a few years ago but got into difficultly with going overdrawn with returned direct debits ect. LloydsTSB closed the account afew years back but have recently put a default on my credit file, are they allowed after this amount of time and no communication?

    Has there been a whole six year period where no payment or written acknowledgement of debt has occurred?

    If so, then Royds should not be entering defaults that far down the line.

    Account was opened in 2006, and went overdrawn in about 2008, so only about 3 years since. :(
  • They must do it in a timely fashion, have a read of this:

    I guess they closed it with an overdrawn balance, hence the default? I would think that as overdrafts are repayable on demand (usually 30 days) you should complain to Lloydsand state you want it correcting.

    Did they issue you with a notice to repay your overdraft?

    After speaking with lloyds this morning they are saying the account remained open until Nov 2010, and passed the account to a company called robinson way in July 2011. I have agreed to repay all the outstanding monies (3 payments @ £300 each) just to clear it but can I get lloyds to remove the default? Or am I stuck with it for 6 years :( They are also saying they sent letters to my old address.

    You won't get the default removed as you obviously did default on the account. They should mark it as satisfied though once you have paid off the debt. But it will remain on file for 6years from the default date.

    Did you inform them of your new address? If you can prove you did then they should have sent the default notice to your new address.

    Overdrafts are more complex with defaults than other credit accounts. It depends on when they formally recalled the overdraft. If that wasn't until 2010 then the default should 'reasonably' between a couple of months and 6months of that date.

    What is the date of the default?

    You could possibly consider a subject access request to the bank at £10 to see when the overdraft was recalled and see if you might have a case.

    Robinson Way are just part of Lloyds - ignore them and just deal with the Lloyds lot. The default will stick unles you can prove it wasn't processed correctly - worth checking if you are bothered about the default though. Had dealings with Lloyds debt team and glad i checked things. Then get the complaints going in if they have messed up. Good luck with it.....
