Hello everyone ,thankyou fro your kind advice and messages.
I have now received a letter from the land registry today ,notice of interim charging order.
i alson today got a letter from renrons saying I had been given a court date in early january 2012,I am looking for for advice on how to fight it.:(

Ok, I have to say that Restons are sharks! I recv'd my charging order from MBNA via Restons almost exactly 1 year ago. Charging orders are extremely difficult to fight against I'm afraid. As they have been successful in achieving a ccj, this is the next probable step.
Tell me, is this a sole debt on a jointly owned property? If so please read here. If so, there's loads of help & info there. If not, I suggest you take a look over on the CAG forums here. Or try the Legal Beagles here. They can help you put together a witness statement (not as scary as it sounds!) & a budget. I really wish I could help you fight against Restons, they are vile, but rest assured they do hand them out like junk mail atm. Keep us posted on how you get on. x0 -
There's a CAB advice guide on the subject but I think the writer is a bit over-optimistic about the possible defences in that most judges won't accept those arguments.

Hi there,
I am soory to hear about your situation and I am sorry to sound like the harbinger of doom but it is very difficult to fight a charging order. I know to my cost. I had my final charging order hearing yesterday and it was granted. I went to court initially in early November for redetermination on a forthwith judgement but Nationwide applied for an interin CO before the redetermination hearing. Redetermination hearing was adjourned and both CO and redetermination hearing was supposed to be held yesterday. Unsurprisingly, no mention of redetermination was made yesterday and CO was granted almost immediately by judge even though I had all the defences in the book going and I had representation.
Judge very sympathetic and all that but still granted it. He made it unenforceable tho as long as I made reasonable payments, left it up to me as to what that was. Currently on DMP paying £56.00 a month on £5000 debt. I had rang creditor to offer increased payments to £136.00 ( with help from family ) in order to halt CO action, this was mentioned in court but still no deal. All the finanacial institutions seem to be going for Co's and the courts are granting them right , left and centre. Things may be different for you and I wish you luck BUT, be prepared to expect the worst!

pls read the link given in post 2 for the thread on charging orders. by sparklyfairy,,, gives a lot of hope even now that you have a charging order, im a bit of a few steps behind you,
so even that they have a charging order, check out the info as to what may happen and should happen when you do eventually sell
