Not paid after leaving job

I left my job over a month ago and I am still due holiday pay which they haven't paid me after numerous emails and phone calls to them. They have also not sent me a P45.

Any advice on where to go with this?

    Our company send the P45 after the payrun for the next month, so if you left on the 1st Nov, then you would get the P45 at the beginning of Dec after the Nov payrun.

    Due holidays are normally paid at the first opportunity (unless its complex and needs looked at). A simple email to HR might help? I find quite often in our company people forget they don't get the full years entitlement if they leave part way through the year - are you def owed?

    Write, by recorded delivery, setting out exactly what you are owed and give them a short but reasonable period of time in which to pay (e.g 14 days) failing which you will take legal action without further notice.

    If need be you can make an Employment Tribunal claim completely free of charge but you MUST make the claim within three months of leaving so don't be strung along.
  • I left the end of September, I have emailed and phone them so many times and all I get back is 'someone will be in contact with you' 'we are looking into this'
    Personally I think they're taking the !!!!

    Write to them now and they might be able to included it in this months payment run (I'm assuming they do an end of month run). Do a formal letter by Recorded delivery or Special Delivery. As said above give them 7 or so days and then file a Tribunal.
  • They should have paid you by now but it is important that you know that you are not entitled to the FULL years holiday entitlement. If your holiday year runs from 1st April to 31st March and you get say, 20 days holiday [not including bank holidays] then if you left end of Sept you'd only be entitled to 10 days holiday. Also if you took 10 days holiday whilst there you would not be entitled to any holiday payments, alternatively you could have your holiday deducted.
