Can Barclaycard do this ?

Hi all.
I received a letter this morning from Barclaycard.
It was notifying me that my debt (which is almost 5 years old),
has been transfered to an agency and my account closed.
My main question is, can barclaycard transfer my debt before the
5 yrs is up?
(i have made a payment every month, via agreement).
And when i get to April, as the debt is 5 years old, will it not become
statute, and no longer have to pay it?

Hi,
I don't know if they can pass it onto an agency if you have an agreed payment plan. However I believe a debt only becomes statute if it's over 6 years old and no payments have been made in that time and they haven't taken you to court and had judgement.

Sorry. Barclaycard are free to sell the account on at any point.
Also as you have been paying every month, then the debt is not going to become statute barred. That only happens when 6 years have passed without you making a payment or acknowledging the debt in writing.

Yes Barclays can do what they want but suggest you check if they have actually sold this and transferred all the rights to another company. Sometimes banks etc close the account, transfer it to their debt team and then get a debt agency to chase it....what does your letter state?
As well (if the debt has definitively been sold on) you could stop payments, put in a CCA request and see what happens. Details are on the forum about checking enforcability etc....good luck0
