Council Tax taken from Wages

Hi all,

I am behind on my council tax - in fact I used to pay it at the end of the month and not the beginning but after 3 reminders the council asked for the full amount which I obviously couldnt afford So after asking me what I could afford and refusing that (I offered to pay the monthly amount) they applied for a liability order

To my shock today they have taken £200 straight from my wages What if anything can I do? This will cause me severe hardship

  • Sorry - but there's nothing you can do to block the deductions from your earnings - apart from paying off the whole amount.

    The deduction from your earnings shouldn't be a complete shock though. Firstly, you would've been obliged to give the Council your employer details after they got the liability order , so that this could happen. Secondly, as well as sending a Council Tax Attachment of Earnings Order notice to your employer, the Council will have sent you a copy. If you didn't get that you might want to find out why though. But you can't stop the attachment unless you can show that you don't owe the money. And neither you nor your employer has any control over the amount that is taken - it is a fixed percentage based upon your net earnings - plus a small administrative charge your employer can make.
    The only positive is that it is better and cheaper than bailiffs or commitall to prison which are the other courses of action you could've been subjected to.

    You could ask them to reduce the amount they take from your wages each month, but Council Tax is the one outgoing you really do not want to mess around with. The Council have extrordinary powers denied almost everyone else.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    The % to be taken is set in legislation by central government, the council have legal authority to alter it.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
