    Oh well, thanks again for all your help, I think i'm right in saying i can spread the repayment over 12 months so thats what i'll need to do.

    They will probably agree to collect it via your code number. Did the letter give any indication?
  • I am having the same problem and have been told ECS A19 does not apply in my case and the tax is still due. HMRC keep coming up with the same statement - 'We have no record of any information sent by you or a third party which we failed to act on.' I actually agreeded with this saying neither myself or my employer have sent them any information but I did get a staetment from one of their employers who said -
    “it looks as though the amendedcodes were never issued to the pension payers and that is whyboth pensions operated a personal allowance”.
    They still refuse to accept it was their fault. This problem has happened two years running now and all I get is the same comments.

    Perhaps you could give us some specifics as to why you feel HMRC is at fault?

    What has caused the underpayment?

    Well if you accept that neither you nor or your employers have sent any information to HMRC, then HMRC would have had no reason to have issued an amended code would they?
