  • No they do not have to, but I would start by writing to them with a nice letter, explaining why you fell behind and how you want to pay them back. I am unsure from your thread if you are no paying the correct amounts now? You need to explain that you are finding to hard to pay and maybe this is causing you further financial problems. I would ask for a refund of charges and then offer a monthly payment amount. Do this as soon as possible and then post back with the reply.

    Good Luck and HTH.
  • If the nice approach doesn't work, then there are other ways to try and get these stopped.

    How old are the accounts?

    how far behind are payments?

are the accounts with an internal debt collector (e.g. NDR)?

When did you open the accounts?

Have you written to them at all or all done by phone?

If the account is old, you could ask for a copy of your CCA which they are very unlikely to have as most accounts never had one.

I managed to get them to accept a reasonable payment and refund some charges by writing a formal complaint sent signed for which they can't ignore. They (and their collections department) had not been responding to any of my letters including offer of payment and were charging me £12 per month. I told them this was unacceptable.

They refunded £50 of charges, let me pay £50 PM to be reviewed in 12 months, on a 4K balance after that. they also said they would add no more charges as long as the £50 payment was made on time. They did mark my credit file as arrangement to pay.

Some ideas to consider for you.
