I don't know if that would come under a secured loan as do HP for a car or mortgage on a house and therefore not fall into the BR.

Check your paperwork for it and see if it talks about removing the furniture if you fail to pay - a bit like the mortgage disclaimer they put on adverts, i.e. "your home is at risk if you do not keep up with payments..."

Once you've read the T&Cs then it might help to ring the Insolvency Service enquiry line to see what they say too.

If it doesn't fall into your BR and the OR won't give you an allowance for the repayments you'll need to find the money from within your other allowances.

    Hi,

Brighthouse and those like them are providers off goods on HP. As a result, if you don't pay then they can seize the goods that remain unpaid for. There is often a clause saying they MAY take the goods back if the contract holder becomes BR. They would however need to get a court order (as the goods are on private property,no matter how much has been paid) to enter the property to take the goods, unless you allowed this in a voluntary manner.
In reality it will depend on the goods current value as to what they may do.

If another family member or friend were to take over the payments to Brighthouse then our experience is that seems to be fine by them.

HP debts are not treated as 'secured creditors' in BR (as would a mortgage contract) so HP contracts are within the scope of BR.
