unpaid rent from dss

HI everyone,
havent been paid rent since october as they needed tenancy agreement,sorted this out ,then there computers went down ,rang back end of december like they said ,told to ring back end of january ,then told we have to wait up to 14 days!
bearing in mind we have to pay the mortgage and use this money to live on ,we have had to go into overdrafts to live
is this legal? or are they a law unto themselves
